Dear Ms. Esposito,
In late March Innovative Access received an unsolicited fax titled "Homeowner Beware! Experts Say Homeowners Must Act NOW - Rates Drop To Lowest In Years." We believe this fax was sent in violation of Title 47 § 227(b) of the United States Code and Chapter 80.36.540 of the Revised Code of Washington. I called the number in the fax and spoke with John from 1st Metropolitan Mortgage. He gave me your name as the person he hired to send the faxes.
Innovative Access is willing to settle this matter out of court for the sum of $350, payable to "Innovative Access, Inc." For your convenience, I have enclosed two copies of a proposed settlement agreement. If the language is to your satisfaction, please sign them both and mail one to me along with the settlement payment. If the language is not to your satisfaction, please contact me to discuss possible modifications.
If I don't hear from you by Wednesday, May 8, 2002, I will assume that an out-of-court settlement is not possible. In that case, and assuming we can get an affidavit from 1st Metropolitan Mortgage, we will file suit in King County District Court for $500 in damages plus court and service fees.
