My name is Ben Livingston. I am seeking $500 in damages from Satellite Systems Network, a California limited liability corporation, for one violation of RCW 80.36.400, which prohibits recorded commercial telephone solicitations.

On Tuesday, September 18, 2001, I received a recorded call advertising the Dish Network, a satellite television company. The recording told me about some special they were running in which I would get a second receiver at no cost. If I was interested, it said, I should call 1-800-615-1621.

I called the number and a woman answered, "Satellite Systems. How may I direct your call?"

"I don't know," I responded. "I just received a recorded call advertising this number."

"One moment," she said.

I was transferred to an operator named Mark who proceeded to tell me about their special "second receiver free" offer. I asked him for the name of his company and he said it was "Satellite Systems" and that they were the third largest Dish Network retailer. I thanked him for the information and declined to purchase a satellite system.

On Tuesday, October 2, 2001, I started my search for Satellite Systems' business records. The Dish Network's web site listed no such retailer, so I called them and spoke with an operator who was unable to locate any retailer by that name.

I called Satellite Systems again and was transferred to an operator. I told him I was interested in their Dish Network services, but that I had called the Dish Network and they had no record of a "Satellite Systems."

He chuckled and said, "Call them back and tell them we're their third largest retailer in the country."

"And what's your company name?"

"Satellite Systems Network."

"And what state are you in?"

"California."

With that information, I was able to lookup their business records via the California Secretary of State's web site.
