Dear Mr. Baker,

Enclosed is a notice of small claim that I have filed against OB PAG, Inc. for one violation of 47 U.S.C. Section 227, which prohibits unsolicited faxes. On December 28, 2001, I received such a fax advertising Volvo of Tacoma.

My original intent was to go after the "fax blaster" OB PAG, Inc. hired to send this unsolicited fax. After emailing sales@volvooftacoma.com and imd@lexusofbellevue.com for more information, I received a call from a man who offered to remove me from the fax list. I explained that I was looking for information about the fax blaster and the caller refused to divulge such information. I emailed those previously mentioned addresses again and reiterated my request. To date, I've received no response. Because of this, I was forced to sue OB PAG, Inc. directly.

I propose that we settle this matter out of court in one of two ways:

1) For the sum of $525.17 ($500 judgement, $21 filing fee, $4.17 service fee); or

2) For the sum of $25.17 ($21 filing fee, $4.17 service fee) and a signed affidavit stating the name and contact information for the company OB PAG, Inc. hired to send the faxes.
